1. Eligibility: The Office Depot Success In The Making Contest (“Contest”) is open only to legal residents of the fifty (50) United States and the District of Columbia, who have reached the age of majority in their state of residence at the time of entry, and who have a public Facebook, Twitter, LinkedIn, Instagram, or TikTok (collectively, “Social Media Platform”) account. Void outside of the fifty (50) United States and the District of Columbia, and where prohibited, taxed or restricted by law. Obtaining a Social Media Platform account is free of charge and is subject to such Social Media Platform’s restrictions and requirements. Contest may only be entered in or from the fifty (50) United States and the District of Columbia, and entries originating from any other jurisdiction are not eligible. Employees, officers and directors of Office Depot, LLC (“Sponsor”), and its respective parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, Contest administrators, manufacturers or distributors of Contest prizes, and their immediate families (parents, children, siblings, spouse; whether biological, adopted, step or in-law) or members of the same household (whether related or not) are not eligible. Contest is subject to all applicable federal, state, and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor decisions, which are final and binding in all matters related to the Contest. Winning the prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor: Office Depot, LLC (“Sponsor”), 6600 North Military Trail, Boca Raton, FL 33496. THIS CONTEST IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH THE ELIGIBLE SOCIAL MEDIA PLATFORMS.
3. Timing: The Contest begins at 12:00:00 a.m. ET on 03/6/2023 and ends at 11:59:59 p.m. ET on 04/06/2023 ("Contest Period"). Unless otherwise stated, all times are in Eastern Time. Sponsor's computer is the official time-keeping device for the Contest.
4. How to Enter: At the beginning of the Contest, Sponsor will announce the Contest by posting on Sponsor’s Social Media Platform profiles (the "Announcement"), located at www.facebook.com/OfficeDepot, https://twitter.com/officedepot, https://www.linkedin.com/company/3114/, https://www.instagram.com/officedepot/, and https://www.tiktok.com/@officedepot (each a “Page”).
Entrants must submit either (a) a photo and written essay describing their small business, home office & personal career, career in education, experience as a student, or experience as a parent to a student, and what success means to entrant (a “Photo/Essay Entry”); or (b) a 3-minute video describing their small business, home office & personal career, career in education, experience as a student, or experience as a parent to a student and what success means to entrant (a “Video Entry”). Photo/Essay Entries and Video Entries may be referred to interchangeably herein as an “Entry” or collectively as “Entries.”
- Photo/Essay Entries must include at least one (1) photo but no more than three (3) photos. Essays should be at least 12 sentences but no more than 22. Photo/Essay Entries should show and describe you in your element that aligns with how you’ve self-classified (Business owner, Home-office worker, Teacher, Student, or Parent of a Student). Entries must highlight how Office Depot OfficeMax products and/or services have helped you achieve success or how specific Office Depot OfficeMax products and/or services could help you advance towards your definition of success.
- Video Entries must not exceed three (3) minutes in duration. Video Entries should show you in your element that aligns with how you’ve self-classified (Business owner, Home-office worker, Teacher, Student, or Parent of a Student). Video Entries must highlight how Office Depot OfficeMax products and/or services have helped you achieve success or how specific Office Depot OfficeMax products and/or services could help you advance towards your definition of success.
- Limit one (1) Entry per person/email address.

To be eligible, all required information on the Entry form located at officedepot.com/contest must be completed, including, but not limited to, a valid email address, phone number, and mailing address. Sponsor is not responsible for change of telephone number or address. In the event of a dispute regarding the identity of the person submitting an electronic Entry, the Entry will be deemed to be submitted by the Authorized Account Holder (as further defined herein), the person in whose name the email account is registered, provided that person meets all eligibility criteria set forth in the Eligibility section of these Official Rules. “Authorized Account Holder” shall mean the natural person assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The potential winner may be required to show proof of being the authorized account holder. Use of any device to automate entry is prohibited. The Sponsor reserves the right to void all Entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method. This Contest is in no way sponsored, endorsed or administered by, or associated with, the Social Media Platforms. You understand that you are providing your information to Sponsor and not to the Social Media Platforms. Any questions, comments or complaints regarding this Contest shall be directed to Sponsor and not to the Social Media Platforms.
Entries must be in English. Entries must be in keeping with Sponsor's image and may not be deemed offensive, lewd, inappropriate or unsuitable as determined by Sponsor in its sole discretion. Entry does not have to show products, but if an Entry does show products, they must be products sold by Sponsor. Any Entry or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, or that otherwise violates or infringes (or may infringe) any copyright, or other proprietary right of any entity or person living or deceased (including, but not limited to, rights of privacy or publicity or portrayal in a false light) will not be considered and may disqualify the entrant. Entries may not include any person’s full name (other than the Entrant’s). Entrants may not copy or otherwise plagiarize any material used in the Entry from any other source. Sponsor has the sole discretion to determine whether an Entry meets these requirements and qualifies for the Contest.
By entering, you represent and warrant that your Entry: (a) is wholly original; (b) does not incorporate or include anything that would require the consent of any third party who has not expressly authorized Entrant to display his/her name or likeness in the Entry or otherwise use such name or likeness in accordance with these Official Rules; and (c) does not violate any copyright, trademark, publicity right, privacy right, or any other right of any third party. Upon Sponsor’s request, you will provide any copies of a third party written consents associated with your Entry.
By submitting an Entry, Entrant hereby grants the Sponsor, its affiliates, subsidiaries, assigns, licensees, designees and legal representatives the irrevocable, perpetual, worldwide digital and other rights to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Entry, or excerpts of the Entry (as such may be edited and modified by the Sponsor in its discretion) for editorial, commercial, promotional and all other purposes (including posting on the Social Media Platforms, Sponsor-affiliated websites, television and/or other Sponsor-selected advertisements). In addition, Entrant hereby assigns to the Sponsor all rights, titles, and interests that he/she may be deemed to have in any reproduction, product, or derivative work using or incorporating the Entry. Entrant further agrees to waive any moral rights in and to the Entry. Automated, script, macro or robotic Entries submitted by individuals or organizations will be disqualified. All Entries submitted become the property of the Sponsor and will not be returned. No information regarding Entries or judging, other than as otherwise set forth in the Official Rules will be disclosed.
5. Judging: At the close of the Contest Period, all Entries will be judged by a panel of judges, determined by Sponsor in Sponsor’s sole discretion, based on the following weighted criteria:
Message Originality – How realistic is the message about what success means to you, the entrant? Does the message display an actionable plan for how Office Depot OfficeMax products and/or services have already helped or would help advance your small business, home office or educational goals? Are the goals measurable? 20%
Outline of Products and/or Services – Clear outline of how the Office Depot OfficeMax products and/or services were, or will be, used to achieve success in entrant’s small business, home office, personal career, education career, experience as a student, or experience as parent of a student. 40%
Presentation – Is the concept presented creatively? How much importance was paid to audio visual quality (if a Video Entry) or to visual/written word (if a Photo/Essay Entry) and attention to detail. Are the points in the Entry clearly communicated? 20%
Overall impression – How well did all of the elements of the Entry work together to convey the importance of having Office Depot OfficeMax products and services to support the entrant’s goals toward success? 20%
In the event of a tie, tied Entries will be re-judged by the same panel of judges based solely on the Outline of Products and/or Services. Entrants agree to be bound by these Official Rules and the decisions of the Judges, which shall be final and binding in all respects relating to this Contest.
Sponsor will select sixteen (16) entrants as potential winners. The potential winner will be notified by email on or about April 28, 2023. If the potential winner does not respond as directed within forty-eight (48) hours of sending of the notification email, he/she forfeits prize. Any forfeited prize will not be awarded.
6. Prizes: Each verified winner will receive one (1) Five Hundred and 00/100 Dollar ($500.00) Office Depot OfficeMax Merchandise Card. Limit one (1) prize per winner and limit one (1) prize per household. Prizes will be mailed to the address given to Sponsor by the potential winner via email, approximately 6-8 weeks after winner is verified. Undeliverable or unclaimed prizes will not be awarded. Total approximate retail value of all prizes is Eight Thousand and 00/100 Dollars ($8,000.00).
Prizes are not transferable or redeemable for cash and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Winner may be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release within 48 hours of the date on the prize notification, or the prize may be forfeited and awarded to an alternate winner. All federal, state, and local taxes (including income and withholding taxes), if any, are the sole responsibility of winner and winner agrees to sign required tax reporting forms or the prize may be forfeited and awarded to an alternate winner. Any other costs and expenses associated with prize acceptance and use not specified herein as being provided are each winner’s responsibility, regardless of whether prize is used in whole or in part. All prize details are at the Sponsor’s sole discretion. Winner acknowledges that Sponsor has not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. If prize notification or any other correspondence is returned as undeliverable, or if potential winner is determined to be ineligible or otherwise not in compliance with these Official Rules, such potential winner may be disqualified and associated prize forfeited.
7. Release: Entrants are solely responsible for their own conduct. By receipt of any prize, winner agrees to release and hold harmless the applicable Social Media Platform, Sponsor, its parents, subsidiaries, affiliates, suppliers, distributors, advertising and promotion agencies, Contest administrators and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize. As a condition of entry, entrants agree (and agree to confirm in writing): (a) to release Released Parties from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of any prize or any use of the Entry; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any prize awarded or use of the Entry, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By accepting prizes, winner(s) agree (and agree to confirm in writing) to be bound by these Official Rules and the judge’s decisions and to release the Released Parties from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Contest or arising out of or related to the awarding, receipt, possession, use and/or misuse of any prize or participation in any prize-related activities or through the use of any prize.
8. Publicity: Except where prohibited, participation in the Contest constitutes entrant’s agreement to Sponsor’s (and its agents') use of entrant’s name, likeness, photograph, voice, opinions and/or city and state of residence for advertising and trade purposes and online without further compensation, unless prohibited by law. (See section 4 for our rights.)
9. General Conditions: Your Entry in this Contest constitutes your consent to be bound by these rules, the decisions of Sponsor and for the use of your information for the purposes of administration of this Contest. All entries are subject to verification prior to awarding a prize. Sponsor is not responsible for lost, stolen, late, misdirected, damaged, incomplete or illegible entries, or postage-due mail, or for transactions that are lost or fail to enter the processing system, are processed, reported, or transmitted late, or are lost for any reason including computer, telephone, paper, or any other malfunction including human error. Sponsor, at its sole discretion, reserves the right to cancel or modify this Contest if fraud, technical failures (including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention) or any other causes beyond the control of Sponsor compromise the integrity of the Contest. Sponsor reserves the right, in its sole discretion, to disqualify any entrant who attempts to tamper with the entry process in any manner. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If selected as a winner, Entrant agrees to Sponsor’s use of Entrant’s name, likeness, city and state of residence for advertising and trade purposes and online without further compensation, unless prohibited by law. All Entries become the sole and exclusive property of the Sponsor and receipt of Entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, postage-due, misdirected, technically corrupted or garbled Entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Contest, entrants fully and unconditionally agree to be bound by these rules and the decisions of the Sponsor, which will be final and binding in all matters relating to the Contest.
10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of Entries; (5) late, lost, undeliverable, damaged or otherwise impaired Entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize.
11. Disputes: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF FLORIDA, U.S., WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S OR CANADIAN LAWS. The parties agree that the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida shall have exclusive jurisdiction to hear and determine any claims or disputes between the parties arising out of or related to the Contest, unless federal jurisdiction is available, in which case the Southern District of Florida, West Palm Beach Division, shall have exclusive jurisdiction to determine any claims or disputes arising out of or related to this Contest. The parties expressly submit and consent in advance to such jurisdiction in any action or suit commenced in such court, and each party hereby waives any objection that it may have based upon lack of personal jurisdiction, improper venue or forum non conveniens.
